Spanish Nationality After Arraigo Familiar

If you already hold residence in Spain through arraigo familiar and you are wondering when you can apply for Spanish nationality, this page is about that specific step: the nationality file of someone whose residence came through the family route, most often as the parent of a Spanish minor.

It is a common situation in Barcelona and it comes with a specific set of misunderstandings, all of them expensive in time. The two procedures are separate: arraigo familiar is a residence authorisation, and nationality by residence is a different file, decided by different criteria, years later.

Arraigo familiar gives you residence, not a shortcut to nationality

This is the assumption behind most of the enquiries we receive, and it does not hold. The family link that justified your arraigo does not, by itself, shorten the period of residence that nationality requires.

The required period depends on your circumstances, not on how you obtained your card. The general rule is ten years of legal residence, with reduced periods for specific situations set out in the Civil Code. Being the parent of a Spanish child is not one of them: that circumstance opens the door to residence, which is precisely what arraigo familiar did for you, and stops there.

What does often shorten the clock for this profile is something else entirely: nationality of origin. Applicants from Ibero-American countries, Andorra, the Philippines, Equatorial Guinea and Portugal, and Sephardic Jews of Spanish origin, are in the two-year group, and a large share of arraigo familiar holders in Barcelona fall into it. The years that earned you the arraigo do not count towards the ten

This is the point that costs the most, and almost nobody arrives knowing it.

Arraigo is granted precisely because you had been in Spain for a period without a residence permit. Nationality by residence requires residence that is legal. Those earlier years are presence, not legal residence, and they do not count towards the period. The clock starts when the authorisation begins, not when you arrived.

People who have lived here for eight years, three of them documented, routinely assume they are close. They are three years in, not eight. Knowing that at the start changes what you do with the next few years; discovering it at the Civil Registry does not.

Continuity is what actually breaks these files

The period has to be continuous and immediately prior to the application. A file that comes from arraigo familiar has more joints than most, and each joint is a place where continuity can break:

• The gap between the arraigo and what came after it. Arraigo authorisations are temporary and the case normally moves on to another type of residence. If a renewal or a modification was resolved late, or requested late, there may be a gap on paper even though you never left.
• Periods when the card had expired while the renewal was pending. What the file shows is what counts, and it is not always what happened.
• Absences from Spain. Long or repeated trips can be read as an interruption, depending on their length and frequency.
• The padrón. Your registration history is the backbone of the evidence. A move that was never updated, or a period registered in another municipality, turns into a question you have to answer years later.

• Your permit history end to end: the date each authorisation started, when each card was issued and whether the sequence has holes.
• The padrón history, matched against that sequence.

• Whether the modification or renewal that followed the arraigo was resolved in time, because that is the joint where this profile most often loses years.
• Whether any period of the file depends on your child’s documentation, and whether that documentation is current.
