Renewing a non-lucrative residence permit in Spain is not simply a matter of proving you still have money. The regulation attaches five conditions to the renewal and two of them are about what you did during the previous card, not about your situation today: you must have kept your health insurance for the whole validity, and you must have actually lived in Spain for more than 183 days in the calendar year. Those are the two that catch people who spent long periods abroad or let a policy lapse. This guide sets out the window, the conditions and what the file has to show.

The window: two months before, and a three-month grace period
Article 64 of Royal Decree 1155/2024 says the renewal must be requested at the competent immigration office during the two months before the expiry date. Filing inside that window extends the validity of the previous authorisation until the procedure is resolved, which is what keeps you legal while the office works.
There is also a grace period, and it is worth understanding precisely. If the application is filed within the three months after expiry, the previous authorisation is likewise extended until resolution, but without preventing the corresponding penalty procedure for the infringement in Article 52.b) of Organic Law 4/2000.
In plain terms: filing late does not automatically sink the renewal, but it is not free either. The safe move remains the two-month window.
The five conditions
| Condition | What Article 64.2 requires |
|---|---|
| Valid authorisation | Hold a non-lucrative temporary residence authorisation in force, or be within the three months after its expiry. |
| Economic means | Sufficient means for living and accommodation costs, including the family’s where applicable, for the period the renewal covers, without carrying out any work or professional activity, on the terms of Article 62. |
| Health insurance | Having kept it during the validity of the authorisation being renewed, and continuing with it. |
| Children in school | Dependent minors of compulsory school age enrolled while they remain in Spain. |
| Fee | The processing fee paid. |
| Real residence | Having resided really and effectively in Spain for more than one hundred and eighty-three days during the calendar year. |
The two conditions that are really about the past
Insurance continuity. The wording is deliberate. It does not ask whether you have a policy now; it asks whether you kept one during the validity of the card you are renewing. Someone who cancelled after getting the card and took out a fresh policy a month before renewing has a gap that the text is written to catch. What helps is continuity evidence: policy documents and payment records covering the period, not just the current certificate.
More than 183 days. This is the condition that surprises people who treated the permit as a flexible base while spending half the year elsewhere. It is not about intention or about owning a home here; it is about days actually resided in Spain in the calendar year. Keep whatever ordinarily evidences presence over time, and be aware that this figure is also the usual threshold in tax residence discussions, which is a separate matter with its own consequences worth understanding before you file.
What goes with the application
Article 64.3 says the application, on the official form, must be accompanied by documentation proving the conditions above, among others a complete copy of the valid passport or travel document recognised in Spain, plus the documents evidencing each requirement.
Practical order that avoids a wasted appointment:
- Check your expiry date and count back two months. That is when the window opens.
- Gather insurance continuity for the whole period, not the latest receipt.
- Assemble the means evidence for the renewal period ahead and for the household you actually have.
- If there are school-age children, have the enrolment confirmation ready.
- Pay the fee and keep the proof with the file.
- Reconstruct your presence in Spain across the calendar year before you are asked for it.
How this connects with the rest of your file
If you are still at the earlier stage, our guide to the non-lucrative visa for Spain covers the initial route. On the insurance side, the regulation sets a standard rather than a price, and we set it out article by article in what the law asks of a health insurance policy. If your circumstances changed and a different route now fits better, our residency applications service is the place to start that conversation.
