Health Insurance for Spanish Residence: What the Law Actually Asks For

Almost every residence route in Spain asks you for health insurance, but the regulation does not describe the policy the same way in every case. In most articles it says three words: a health insurance policy. In only one place does the text spell out what that policy has to look like. If you are comparing quotes and wondering which conditions actually matter for your file, that one article is the benchmark worth reading, and the rest of this guide explains where it applies and where the wording is looser.

Where the requirement is written

The rules are in Royal Decree 1155/2024, of 19 November, the regulation implementing Organic Law 4/2000, in force since 20 May 2025. Different routes sit in different articles:

Route Article What the text says about insurance
Visa requirements (including long-stay for higher studies) Art. 35 i) The only place with a full standard: insurer authorised to operate in Spain, cover similar to the public system’s basic portfolio, valid for the planned stay.
Family of a long-stay higher-education holder Art. 56 Requires that the person “has health insurance”.
Non-lucrative temporary residence Art. 61 b) Requires having health insurance, alongside sufficient means without working.
Renewal of non-lucrative residence Art. 64 c) Requires having kept it during the whole validity of the authorisation and continuing with it.
Family reunification Art. 67.3 Insurance for the sponsor and the family members listed in Article 66.

The standard that the rest of the routes are read against

Article 35 i) is the detailed one. It asks for a policy that meets three conditions together:

  • Arranged with an insurer authorised to operate in Spain. Not simply an international policy that happens to reimburse treatment received in Spain.
  • Cover similar to that of the common basic portfolio of healthcare services of the National Health System. This is about the scope of what is covered, which is why a travel or repatriation policy is usually the wrong product.
  • Valid for the duration of the stay applied for. A policy that expires mid-way through the period you are asking for does not match the request.

Where another article only says “health insurance”, that shorter wording is not an invitation to file a weaker policy. In practice the office reviewing the file is looking at the same things: who issued it, what it covers, and how long it runs. If you are still choosing between products, our guide on how to choose health insurance in Barcelona goes through the comparison itself.

The renewal trap that catches non-lucrative residents

Article 64 c) is worded differently from the rest, and the difference is the whole point. For renewal of a non-lucrative residence it does not ask whether you have insurance today. It asks that you have maintained it while the authorisation was valid and that you continue with it.

That turns a gap into evidence. Someone who cancelled a policy after getting the card and took out a new one shortly before renewing has a discontinuity that the wording is designed to catch. If you are approaching a renewal, the useful thing to gather is continuity: policy documents and payment records covering the period, not just the current certificate.

Reunification: the requirement is not only for the person arriving

Article 67.3 asks for health insurance for the sponsor and the family members of Article 66. Families often insure the relative who is coming and leave the sponsor out, because the sponsor is already living in Spain and often already covered through work. If that is your case, the practical step is not to buy a second policy blindly: it is to be able to evidence the cover that already exists, for everyone the article names.

Students: check the wording, and check the dates

For the long-stay route for higher studies, the insurance requirement comes through the visa article, which is the detailed one. Because the standard mentions validity “for the duration of the stay applied for”, enrolment dates and policy dates should line up. Our guide to the student stay framework covers the rest of that route, including what the authorisation allows once it is granted.

What to check on a policy before you file

  1. Who issued it. An insurer authorised to operate in Spain.
  2. What it covers, compared against the scope of the public system’s basic portfolio, rather than against a price.
  3. How long it runs, against the period you are requesting.
  4. Who is named on it, when the route requires cover for more than one person.
  5. Whether it has been continuous, if a renewal is coming.
  6. That the certificate states these things explicitly. A receipt proving you paid is not the same as a certificate describing the cover.

What this guide deliberately does not tell you

It does not quote premiums, and it does not list which specific products qualify. Prices and product conditions change between insurers and between years, and the regulation does not set them. What the regulation does set is the standard above, which is stable and is what the file is assessed against. Conditions, reference amounts and processing details are updated periodically, so confirm the ones in force when you file.
